Terms and conditions

These terms and conditions apply to the website gymply.ch, the Gymply demo studios and the use of the Gymply platform.

Operator

What we offer

Gymply is software for online booking and appointment management for businesses with classes or appointments, such as fitness studios, hair salons or massage practices. Gymply provides this software to those businesses. Gymply itself does not offer any classes, appointments or treatments.

Demo studios

The demo studios linked from gymply.ch (for example demohair.gymply.ch) are fictional and only serve to try out Gymply. A booking in a demo studio creates no contract and no right to any service; no appointment takes place.

Payments in the demo studios run exclusively in the test mode of the payment provider Payrexx: only test cards are accepted and no money is charged or transferred. Do not enter real payment details in a demo studio.

An e-mail address is enough for an account in a demo studio; booking confirmations are sent to it. Demo accounts and demo bookings may be deleted at any time.

Bookings with businesses that use Gymply

If you book through Gymply with a real business, the contract for the booked service is concluded solely between you and that business. Its prices, cancellation terms and terms and conditions apply. Gymply is not a party to that contract.

Payments

Payments for a business’s bookings and products go directly to that business, through its own account with a payment provider (for example Payrexx). Gymply does not receive, hold or pass on customer funds.

Refunds follow the business’s terms and are processed through its payment provider.

Use of the platform by businesses

Businesses that use Gymply conclude a separate contract with the operator; scope, price and term follow from the respective offer. Each business connects its own payment provider account and is solely responsible for its offers, prices and terms.

Availability and liability

We strive for uninterrupted operation but cannot guarantee continuous availability. To the extent permitted by law, liability for slight negligence is excluded. The respective business is liable for the booked services.

Data protection

How we process personal data is described in our privacy policy. If you book with a business, its own privacy policy applies as well.

Changes

We may amend these terms. The version published on this page applies.

Governing law and jurisdiction

Swiss law applies. The place of jurisdiction is Zurich, unless mandatory provisions, in particular for consumer protection, provide otherwise.
